国际笔会在哥伦比亚波哥大举行的第74届代表大会上通过
（2008年9月17-22日）
欢迎：自2007年7月国际笔会上届代表大会以来，已知王德佳获保外候审释放，程翔获假释，岳天祥、喻华峰和胡石根被减刑释放。
考虑到：对言论自由权的继续压制遍及中国各地，从召开2008年奥运会的首都北京市到发生大地震的内地四川省，从香港和澳门特别行政区到西藏、新疆、内蒙古等地区。
失望于：中国并未恪守在主办奥运期间确保新闻自由的承诺，反而加强打击自由媒体，包括开除甚至逮捕新闻工作者、停止发行、查禁书籍，以及封锁涉及政治敏感事件的新闻；尤以山东两位记者齐崇怀和贺彦杰案为证，他们因报导官方腐败，就被以“敲诈勒索”罪名分别判刑四年和二年。
警觉到：对中国知识分子肆意骚扰打击，尤其是对网络作家和新闻工作者的任意逮捕，目前有40多人系狱，使中国继续为世界上监禁最多作家和新闻工作者的国家。
不安于：继续采用包括恶名昭著的“劳动教养”制度的行政拘留，不经自己法律保障的公正程序监禁异议作家高达三年。
更不安于：增加滥用中国刑法，对异议作家和坦率的新闻工作者，任意加罪“危害国家安全/社会治安”、“煽动颠覆国家政权” “非法持有/泄露国家秘密”，以压制言论自由和新闻自由，加罪独立出版人“非法经营”。
关注到：香港和澳门的言论自由正日益遭受威胁的证据，例如拒绝独立中文笔会张裕等几位新闻工作者入境参加香港“新闻自由日”活动。
担忧于：日益扩大的互联网监控遍布全国，成千上万的网站遭封锁，受欢迎的中国网上论坛被关闭，网络作家和新闻工作者因为在海外网站上发表批评报道和评论受到骚扰和监禁，如胡佳、陈树庆和吕耿松被以“煽动颠覆”罪名判刑，陈道军、曾宏玲、黄琦被关押。
震惊于：对独立中文笔会会员日渐增加的迫害，包括先后判决师涛（十年）、张林（五年）、杨天水（十二年）、张建红（六年）、严正学（三年），重新逮捕杜导斌，骚扰、短期监禁、限制出入境30多人，包括副会长江棋生，理事刘晓波、赵达功、王怡，会员廖亦武、李剑虹、刘荻、滕彪、李建强、蒋亶文、刘逸民、刘水、周远志、孙文广等，对居住瑞典的中国公民张裕拒绝入境探亲。
愤怒于：暴力镇压今年3月14日以来在拉萨和许多其它藏区的大规模和平抗议，以及对西藏、新疆和内蒙等自治区继续推行压迫措施。
督促中华人民共和国政府：
──停止骚扰打压独立中文笔会会员，取消对他们出入中国大陆自由的限制，尤其是对他们参加国际笔会会议的限制；
──停止其致力于监控网上空间，立即释放因和平表达自己观点而系狱的所有网络作家；
──释放西藏、新疆、内蒙等自治区侵犯言论自由权而监禁的所有人士，包括西藏作家和记者达瓦坚赞、江白加措、卓玛嘉，维吾尔作家阿卜杜勒加尼·梅梅特民、拖乎提· 吐尼雅孜、阿布露莎、努尔莫哈提杨·亚辛和蒙古作家哈达；
──释放在中国所有系狱作家和新闻工作者，包括：师涛、张林、杨天水、张建红、严正学、黄金秋、郑贻春、孔佑平、徐泽荣、徐伟、靳海涛、杨子立、张洪海、李智、杜导斌、王晓宁、郭起真、杨茂东、陈树庆、吕耿松、胡佳、齐崇怀、贺彦杰、陈道军、曾宏玲、黄琦。
──批准中国政府1998年10月签署的“公民权利和政治权利国际公约”。
──致力中国司法制度的全面而有意义的改革，以符合国际标准和自己的宪法，确保公平审判、充分的辩护权和上诉权、律师的合法执业，以及保证犯人健康与安全的监狱制度，尤其要停止滥用“颠覆”加罪作家，以“持有/泄漏国际秘密”加罪新闻工作者，并废除恶名昭著的“劳教制度”。

WiPC 2008 Resolution: China
The Assembly of Delegates of International PEN, meeting at its 74th Congress in Bogota, Colombia, 17-22 September 2008
Welcomes the releases of WANG Dejia on bail, CHING Cheong on parole, YUE Tianxiang, YU Huafeng, and Hu Shigen due to the respective reduction of their sentences, since the last Congress of International PEN in July, 2007.
Considering the continuous suppression of the right to freedom of expression throughout China, from its capital city of Beijing hosting the 2008 Olympics to the inland province of Sichuan suffering from the 12 May 2008 earthquake disaster, the Special Administrative Regions of Hong Kong and Macao, the Autonomous Regions of Tibet, Xinjiang, and Inner Mongolia.
Disappointed by the fact that China has not kept its commitment to ensure press freedom when hosting the 2008 Olympics but instead has intensified the governmental assaults on liberal media, in which journalists are dismissed and even arrested, publications closed, books banned and news blackouts imposed on politically sensitive events; particularly illustrated by the case of QI Chonghuai and HE Yanjie, two journalists in Shandong Province, who were sentenced to imprisonment, respectively for 4 and 2 years, on the charge of “blackmailing” for their reporting on official corruption.
Alarmed by the relentless harassment of and attacks against Chinese intellectuals, particularly the arbitrary arrests of Internet writers and journalists of whom over 40 are currently imprisoned, thus maintaining China as the largest jailer of writers and journalists in the world.
Disturbed by the continuous use of administrative detention, including the infamous “Re-education Through Labour” (RTL) system, to jail dissident writers for up to 3 years without the due process guaranteed under its own laws.
Further Disturbed by the increasing abuse of China’s Criminal Law by arbitrarily charging dissident writers and outspoken journalists with criminal offences to suppress freedom of expression and the press, in particular “endangering the social/national security”, “inciting subversion of state power” and “illegally holding/leaking state secrets”, as well as charging independent publishers with “illegal business practices”.
Concerned by evidence of growing threats to freedom of expression in Hong Kong and Macao, such as denying several journalists, including Dr. Yu ZHANG of the Independent Chinese PEN Center (ICPC), permission to enter Hong Kong for a World Press Freedom Day event.
Worried about the growing Internet censorship throughout the country, in which thousands of websites are blocked, popular Chinese Internet forums discussing sensitive issues closed, and online writers and journalists harassed and imprisoned for their publications of critical reports and commentaries on overseas websites, including the sentences against HU Jia, CHEN Shuqing and LU Gengsong on the charge of “inciting subversion”, as well as the detentions of CHEN Daojun, ZENG Hongling and HUANG Qi.
Shocked by the increasing persecution of Independent Chinese PEN Centre (ICPC) members, including the sentencing of SHI Tao (10 years), ZHANG Lin (5 years), YANG Tongyan (12 years), ZHANG Jianhong (6 years) and YAN Zhengxue (3 years), the re-arrest of Du Daobin, the harassment, brief detention and travel restriction of more than 30 members, including its Vice-president JIANG Qisheng, Board Members LIU Xiaobo, ZHAO Shiying and WANG Yi, members LIAO Yiwu, LI Jianhong, LIU Di, TENG Biao, LI Jianqiang, JIANG Bo, XIONG Zhongjun, LIU Shui, ZHOU Yuanzhi and SUN Wenguang, and the denial of ZHANG Yu, a Chinese citizen residing in Sweden, permission to enter the Chinese mainland for a family visit.
Outraged by the violent crackdown on the largely peaceful protests in Lhasa on 14 March 2008 and in many other Tibetan areas since then, and China’s continued imposition of repressive measures in the autonomous regions of Tibet, Xinjiang and Inner Mongolia.
Urges the government of the People’s Republic of China to:
Stop the harassment and persecution of ICPC members, and lift all restrictions on their freedom to exit and enter mainland China, particularly to attend International PEN conferences;
Cease its efforts to censor cyberspace and to immediately release all Internet writers jailed for peacefully expressing their opinions;
Release all prisoners in the autonomous regions of Tibet, Xinjiang and Inner Mongolia who have been detained in violation of their right to freedom of expression, including Tibetan writers and journalists Dawa Gyaltsen, Jampel Gyatso and Dolma Kyab, Uighur writers Abdulghani Memetemin, Tohti Tunyaz, Mehbube Ableh and Nurmuhemmet Yasin, and Mongolian writer Hada;
Release all imprisoned writers and journalists in China, including SHI Tao, ZHANG Lin, YANG Tianshui, ZHANG Jianhong, YAN Zhengxue, HUANG Jinqiu, ZHENG Yichun, KONG Youping, XU Zerong, XU Wei, JIN Haitao, YANG Zili, ZHANG Honghai, LI Zhi, Du Daobin, WANG Xiaoning, GUO Qizhen, YANG Maodong, CHEN Shuqing, LU Gengsong, HU Jia, QI Chonghai, HE Yanjie, CHEN Daojun, ZENG Hongling and HUANG Qi;
Ratify its signature of the International Covenant on Civil and Political Rights in October 1998;
Engage in a complete and meaningful reform of the Chinese legal system in accordance with international standards and its own Constitution to guarantee fair trials, the full rights of defence and appeal, the legal practices of attorneys, and a prison system that ensures the health and safety of inmates; particularly to cease the practice of using the charge of “subversion” against writers and of “holding/leaking state secret” against journalists; and to abandon the infamous RTL system.
